Implementation of Copyright Law in Bengali Publications in India Over the Last Decade: Realities and Challenges

ABSTRACT
The importance of Copyright in protection the rights of an author and how far that is protected by the Copyright Act and its impact on publishers all matters that have been taken into consideration in the present article. In Indian Copyright Act some sections consists of publication’s rights and author's rights. For example Act No. 5, 6, 20, 22, 23, 28, 31, and 32 consists of the publication’s rights and Section 14, 16, 17, 18, 20, 23, 28 and 31 are related to the author's rights. In the other acts are not related to publication’s rights and rights to creators. Act No. 33 to 43 are related to copyright society, Rights of Broadcasting Organization and of Performers, International Copyright. Act no. 63 to 79 are related to Offences, Appeals, and Miscellaneous1 . Some information has been collected from publishers and writers about publications of Bengali books. The information has been analyzed according to Copyright Act. The present paper focuses what is the real picture of the application of Copyright Act, and what the problem in applying Copyright Act. This paper also shows scenario of Bengali publication in India previous ten years.
